Right. I saw Lucius this morning.
If Draco isn't found in the next fortnight, Lucius has agreed to 'answer for his crimes.' Lucius is assuming he'll die for them. That's not actually a guarantee. The most significant crime Draco was actually accused of was teaching Hermione Granger magic. The punishment for that has varied significantly over the years, ranging from death and being given to the Dementors, to Azkaban, to being re-classified as a mudblood and sent to the camps. Any of those are possibilities for Lucius, if he's truly going to be punished in his son's stead. It's possible that he's focused on death because he finds the other possibilities more terrifying. (I would personally prefer to die than receive a life sentence to Azkaban. But opinions on this differ.)
I thought a bit about what it would take to kidnap Lucius while he was distracted. This morning, while he was as distracted as he gets, really. It would be difficult. His wand is never out of reach, ever. It would take at least four, in addition to me, and you'd need to be prepared for him to use me as a shield (and not hesitate when he did). The room we meet in is warded to us -- I thought about whether there was a way I could do it myself, and I'm not sure it's possible. I'm fast, but he's faster.
There are problems with giving them a false body, like the tapestry. But if Lucius and Narcissa are the only ones who know it's not Draco, it'll be in their hands. They can blast Draco off the tapestry and lie, if they want to save Lucius. (Though, frankly, I don't think a verbal agreement with the Lord Protector is worth the parchment it's written on. He might be killed regardless of what Draco does.)

He thinks Draco's probably being held captive and the people holding him will be unwilling to let him go. Because, reasonably enough, a bunch of enemies of the state will see Lucius's death as an unexpected gift, not something to be avoided.
